Manual prepared in terms of section 51 of the Promotion of Access to Information Act, No. 2 of 2000 ("PAIA"), read with the Protection of Personal Information Act, No. 4 of 2013 ("POPIA"), for:
Bindyl (Pty) Ltd, a private company incorporated in South Africa, the "private body".

1. PURPOSE OF THIS MANUAL
PAIA gives people the right to request access to records held by private bodies where the record is required for the exercise or protection of a right. POPIA gives data subjects rights in respect of their own personal information. This manual explains what records Bindyl holds and how to request access to them.

4. RECORDS AVAILABLE WITHOUT A PAIA REQUEST
The following are publicly available on the Bindyl website and may be accessed without a formal request:
- the Terms and Conditions;
- the Privacy Policy; and
- this PAIA Manual.
If you are a registered User, you can view and edit most of your own profile information directly in your account settings, and you can delete your account (and the personal information linked to it) in settings at any time — no PAIA request is needed for that.
5. CATEGORIES OF RECORDS HELD (PAIA s51(1)(e))

6. PROCESSING OF PERSONAL INFORMATION (POPIA)
The purposes for which Bindyl processes personal information, the categories of data subjects, the recipients (operators), cross-border transfers, and security measures are described in full in the Privacy Policy, which forms part of this manual by reference.
7. HOW TO REQUEST A RECORD (PAIA s53)
- Complete Form 2 (Request for Access to Record), available from the Information Regulator at https://inforegulator.org.za (under PAIA Forms).
- Send the completed form to the Information Officer function at support@bindyl.com.
- Identify the record clearly, state the format in which you want access, and — if you are requesting on behalf of someone else — provide proof of the capacity in which you are requesting.
- If you are requesting a record about someone else, you must state the right you seek to exercise or protect and why the record is required for that purpose.
Fees: If you request your own personal information (a "personal requester"), no request fee is payable. Other requesters must pay the request fee prescribed by the PAIA Regulations, and access fees for search, preparation, and reproduction may apply as prescribed.
Timing: We will respond within 30 days of receiving a compliant request, as required by PAIA, or notify you if an extension applies.
8. GROUNDS FOR REFUSAL
A request may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including: mandatory protection of the privacy of a third party who is a natural person; protection of commercial information of the private body or a third party; protection of confidential information; and records privileged from production in legal proceedings. Where only part of a record is protected, the remainder will be disclosed if it can reasonably be severed.
9. REMEDIES
If your request is refused and you are not satisfied with the reasons given, you may:
- lodge a complaint with the Information Regulator (complaints.IR@justice.gov.za); or
- apply to a court of competent jurisdiction.
10. AVAILABILITY OF THIS MANUAL
This manual is available free of charge on the Bindyl website at /paia and on request from the Information Officer. It will be updated whenever the information in it changes materially.
